Terms of Service

    Plain language summary: MyDoctor helps you track your family's health data. It is a wellness tool — not a medical device, and not a substitute for professional medical advice. By using the app, you agree to these terms.
  

1. Acceptance of Terms

By downloading, installing, or using the MyDoctor application ("App") or visiting mydoctorkit.com ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App or Site.

These Terms constitute a legally binding agreement between you and MyDoctorKit LLC ("Company," "we," "us," or "our").

2. Description of Service

MyDoctor is a personal health data management application that enables users to:

Connect Bluetooth-enabled health devices to record vitals
Create profiles for multiple family members
Sync data from wearable devices via third-party APIs
View health trends, history, and generate reports
Optionally sync data to secure cloud storage

3. Not a Medical Device — Important Disclaimer

⚠ Medical Disclaimer: MyDoctor is a consumer wellness application. It is NOT a medical device, does NOT provide medical diagnoses, and is NOT a substitute for professional medical advice, diagnosis, or treatment.

The health data displayed in MyDoctor is for informational and personal tracking purposes only. Always consult a qualified healthcare provider for any medical questions, conditions, or treatment decisions.

Do not use MyDoctor to:

Diagnose any medical condition
Delay or avoid seeking professional medical care
Make treatment decisions without consulting a doctor
Replace any prescribed medical monitoring device

In the event of a medical emergency, call 911 or your local emergency services immediately.

4. Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent that you are 18 or older. You may add family members under 18 as managed profiles under your adult account.

You are responsible for ensuring that any minor profiles you create are managed by a parent or legal guardian.

5. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

Provide accurate, complete information when creating your account
Keep your login credentials secure and not share them with others
Notify us immediately of any unauthorized access at support@mydoctorkit.com
Use PIN protection appropriately for sensitive family profiles

6. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Attempt to reverse engineer, decompile, or modify the App
Interfere with or disrupt the App's infrastructure
Enter false health data with intent to deceive any third party (e.g., an employer or insurer)
Use the App to monitor another person's health without their knowledge and consent
Access another family member's protected profile without authorization

7. Your Data and Content

You own all health data you enter into or sync with MyDoctor. We do not claim any ownership rights over your personal health information.

By using cloud sync, you grant us a limited, non-exclusive license to store, process, and transmit your data solely for the purpose of providing the MyDoctor service to you. This license terminates when you delete your data or account.

You are responsible for the accuracy of data you enter. MyDoctor is not responsible for decisions made based on inaccurate data you have entered.

8. Third-Party Integrations

MyDoctor integrates with third-party services including Oura Ring, Google Health Connect, and Apple HealthKit. Your use of these integrations is subject to the respective third-party terms of service and privacy policies.

We are not responsible for the availability, accuracy, or content of third-party health data sources. Third-party integrations may be discontinued at any time due to changes in third-party APIs or policies.

9. Connected Devices

MyDoctor supports Bluetooth medical devices for personal wellness tracking. Important limitations:

Readings from connected devices are for personal tracking only — not for clinical use
Accuracy depends on the connected device and proper usage per the device manufacturer's instructions
MyDoctor is not responsible for inaccurate readings from third-party hardware
Some devices may require their own app for initial setup before connecting to MyDoctor

10. Subscription and Fees

MyDoctor offers a free tier with core functionality. Premium features may require a paid subscription. Pricing details will be clearly displayed before any purchase. All fees are non-refundable except as required by applicable law or as stated in our refund policy.

We reserve the right to change pricing with 30 days notice to existing subscribers.

11. Intellectual Property

The MyDoctor App, website, logos, and all associated intellectual property are owned by MyDoctorKit LLC and protected by copyright, trademark, and other applicable laws. You may not use our brand assets without prior written permission.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYDOCTORKIT LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of data or health records
Medical decisions made based on App data
Inaccurate readings from connected devices
Interruption of service

Our total liability to you for any claims arising from use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless MyDoctorKit LLC from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time within the App. Upon termination, your right to use the App ceases immediately, and we will delete your cloud-stored data within 30 days per our Privacy Policy.

15. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New Jersey.

16. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via in-app notification and email (if provided). Continued use of the App after changes constitutes acceptance of the updated Terms.
